Terms and Conditions for Social Media Competitions/Giveaways

1. Organizer

The organizer is NIKIN AG, Graben 33, 5000 Aarau.

2. Participation

Eligible participants are residents of Switzerland who are at least 18 years old or of legal age at the time of participation. Employees of NIKIN AG and other persons involved in the conception and implementation of this competition are excluded from participation. The competition is not affiliated with Facebook, Instagram, or other social networks and is not sponsored, endorsed, or organized by them. The organizer reserves the right to exclude participants who are suspected of violating the terms and conditions. No participation fee is required, nor is there any obligation to purchase. The promotion runs for the period specified in the post on the social media platform. Participation is possible throughout the entire promotion period. Persons who use unauthorized aids or otherwise gain advantages through manipulation will be excluded from the competition. In such cases, prizes may be subsequently revoked and reclaimed.

3. Prize and Winner Management

Only the prize described in more detail in the competition will be awarded. Prizes will only be awarded to participants; cash payment of material values or exchange of prizes is not possible. The winner accepts necessary changes to the prize that are caused by factors beyond the control of the companies involved in the competition. Unless otherwise agreed in writing by the organizer of the promotion, prizes will be awarded exclusively directly to the winners. Potential winners will be notified by NIKIN AG. Winners are obliged to contact NIKIN AG within three days from the date and timestamp of the message sent by NIKIN AG, observing the modalities stated in the competition announcement. If the claim to a prize is not asserted within seven days of the initial notification to the organizer, the organizer reserves the right to cancel the prize claim and award the prize to a reserve winner. No liability is assumed for lost, delayed, incorrect, damaged, misdirected, or incomplete claims or claims that cannot be delivered due to technical reasons, delivery issues, or other reasons.

4. Prize Payout

For cash prizes and gift vouchers with a value of over CHF 1,000, the organizer will deduct 35% of the prize (withholding tax) before transferring it to the winner. The winner will receive a confirmation from the organizer for the refund of the withholding tax, which must be attached to their personal tax return. The winner is obliged to declare prizes over CHF 1,000 in their personal tax return. For non-cash prizes with a value of over CHF 1,000, the winner must send the organizer a certificate of residence, which they must obtain at their own expense from the competent authority. The prize cannot be handed over to the winner before the certificate of residence is submitted. If the certificate of residence is not submitted within the deadline (maximum within 10 working days), the prize will be forfeited without any right to compensation. The winner is obliged to declare non-cash prizes with a value of over CHF 1,000 in their personal tax return.

5. Data Protection

NIKIN AG undertakes to comply with legal data protection provisions. Personal data obtained in connection with the competition will not be passed on to third parties or made available to them for use. An exception applies to the winner(s) who give their consent for their name, nickname, age, image, and video to be publicly used for advertising purposes. The submitted contributions (e.g., photos, videos, texts, etc.) are not considered confidential, and by participating in the competition, the participant declares that they have full usage rights to them. The participant also agrees that the organizer may shorten contributions, correct spelling errors, and possibly use the contributions for marketing and its own advertising purposes (e.g., websites, media platforms, printed materials, etc.). By participating in a competition, the participant expressly agrees to receive promotional messages from the organizer for an indefinite period (email, postal mail). The participant can stop the sending of promotional messages immediately and free of charge at any time by notifying the organizer (by phone, email, postal mail, etc.).

6. Exclusion

The organizer reserves the right to check participants and winners before a prize is awarded. This includes, among other things, name, age, and place of residence. The organizer may refuse to award a prize or withdraw the claim to a prize and refuse further participation in the promotion if there is reason to believe that the present terms and conditions or instructions that are part of the terms and conditions have been violated, or if a participant has gained an unfair advantage through their participation in the promotion or has won using fraudulent or otherwise manipulative means.

7. Liability

The organizer is released from all obligations upon handover or mailing of the prize to the winner. The organizer is not liable for losses, delays, or damages to the prize during postal or transport delivery that are caused by circumstances beyond its control. The organizer is not liable for legal and/or material defects of the prize. The announcement of the winners is made without guarantee. No liability is assumed for lost, damaged, misdirected, incorrect, or delayed entries, or for any technical difficulties that may affect the final result of the competition or participation.

8. Premature Termination or Changes

The organizer reserves the right to cancel or prematurely terminate the competition at any time without prior notice and without stating reasons. This applies in particular if proper execution cannot be guaranteed for technical or legal reasons. In such a case, participants have no claims whatsoever against the organizer.

9. Miscellaneous

The decision of the courts is final. No correspondence will be entered into. All costs, taxes, and fees associated with winning a prize are borne by the winner. All disputes in connection with this competition are exclusively subject to Swiss law. The place of jurisdiction is the registered office of NIKIN AG. Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining terms and conditions remains unaffected. These terms and conditions can be changed or withdrawn by NIKIN AG at any time without separate notification.
